We assist clients to determine whether a license is required to export, re-export or transfer in country U.S. goods. An export can include a “deemed” export which is the release of controlled technology or source code outside of the U.S. or to a foreign national in the U.S. The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) administers U.S. laws, regulations and policies governing the export and re-export of commodities, software, and technology (collectively “goods”) falling under the jurisdiction of the Export Administration Regulations (EAR). The EAR regulates the export, re-export and transfer (in-country) of: (i) some less sensitive military items; (ii) commercial items that have both commercial and military or proliferation applications (dual use goods); and (iii) purely commercial items without an obvious military use.
